1. App use
Fitly AI grants you a limited, non-exclusive, non-transferable, revocable license to install and use the app on a device you own or control, solely for your personal, non-commercial use.
2. Eligibility & account
- You must be at least 13 years old (or older where required).
- You agree to provide accurate information and keep it up to date.
- You are responsible for activity under your account.
3. Subscriptions and purchases
- Some features require a paid subscription, billed via Google Play (and in the future, Apple App Store).
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Manage or cancel your subscription in your app store account settings.
- Refunds (when available) are handled under the relevant app store’s policies.
4. Acceptable use
You agree not to:
- Reverse engineer, decompile or attempt to extract source code.
- Use the Service to violate any law or third-party right.
- Upload content that is harmful, infringing, defamatory or offensive.
- Interfere with the Service’s security, integrity or availability.
- Use the Service to build a competing product or to scrape data.
5. AI guidance disclaimer
Fitly AI uses artificial intelligence to provide fitness suggestions, food recognition, calorie estimates and coaching content. AI output may be inaccurate, incomplete or unsuitable for your situation. Always use your judgment and verify important information before acting on it.
6. Health disclaimer
Fitly AI is intended for general fitness, calorie tracking, workouts and habit-building only. It is not a medical device and does not provide medical advice, diagnosis or treatment. Consult a qualified healthcare professional before beginning any new diet or exercise program, especially if you have a medical condition, are pregnant or have any concerns about your health.
7. User content
You retain ownership of content you submit (e.g. food photos, notes). You grant Fitly AI a worldwide, royalty-free license to host, process and display your content as needed to operate and improve the Service. You are responsible for the content you upload.
8. Service changes
We may add, modify, suspend or discontinue features at any time. We may also update these Terms; material changes will be communicated through the app or website.
9. Termination
You may stop using the Service at any time and delete your account through Settings > Account > Delete Account or by emailing support@fitlyai.online. We may suspend or terminate your access if you violate these Terms.
10. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, Fitly AI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or data, arising out of your use of the Service. Our aggregate liability for direct damages will not exceed the amount you paid us in the 12 months preceding the claim.
12. Governing law
These Terms are governed by the laws of your country of residence to the extent required by applicable consumer protection law, otherwise by the laws applicable to Fitly AI’s operating entity.
