1. The Service
Fitly AI provides general fitness, nutrition, habit-building, and wellness guidance. Features may include calorie and meal tracking, food scanning, Glow self-care insights, workouts, streaks, reminders, and an AI Coach. Features are provided for personal, non-commercial use.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Fitly AI app on a device you own or control, solely for your personal use under these Terms.
3. Eligibility and account
- You must be at least 13 years old (or older where required).
- You agree to provide accurate information and keep it current.
- You are responsible for activity under your account.
4. Subscriptions, trials, and renewals
- Some features require a paid subscription. Subscriptions are billed by Apple App Store or Google Play and managed through RevenueCat.
- If a free trial is offered, your subscription begins automatically at the end of the trial unless you cancel before the trial ends.
- Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple App Store or Google Play account settings.
- Refunds, when available, are handled under the relevant app store’s policies. We do not process payments directly.
5. AI guidance and accuracy
Fitly AI uses artificial intelligence to power features such as food recognition, calorie and macro estimates, Glow self-care insights, and AI Coach responses. AI results can be inaccurate, incomplete, or unsuitable for your situation. Calorie and nutrition estimates from food scans are approximations and should be treated as a guide rather than an exact measurement. Always use your own judgment and verify important information before acting on it.
6. No medical advice
Fitly AI is intended for general fitness, nutrition, habit-building, and wellness purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. Glow scan results are not a dermatological or clinical assessment. Consult a qualified healthcare professional before beginning any new diet, exercise program, or supplement, and before acting on any information shown in the app, especially if you have a medical condition, are pregnant, have an eating disorder history, or have any concerns about your health.
7. Your responsibility for health decisions
You are solely responsible for your health and lifestyle decisions and for how you use the Service. Fitly AI does not guarantee any specific results, weight outcomes, or transformations. Stop using the Service and seek medical attention if you experience any condition that requires professional care.
8. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code.
- Use the Service to violate any law or third-party right.
- Upload content that is harmful, infringing, defamatory, sexual, deceptive, or otherwise inappropriate.
- Submit photos of people other than yourself without their consent to the Glow scan or any image-based feature.
- Interfere with the Service’s security, integrity, or availability, including by automated scraping or excessive requests.
- Use the Service to build or train a competing product.
9. User content
You retain ownership of content you submit, including food photos, Glow photos, notes, and AI Coach messages. You grant Fitly AI a worldwide, royalty-free license to host, process, and display your content as needed to operate, secure, and improve the Service. You are responsible for the content you upload.
10. Service changes
We may add, modify, suspend, or discontinue features at any time. We may also update these Terms; material changes will be communicated through the app or website.
11. Termination
You may stop using the Service at any time and delete your account through Settings > Account > Delete Account or by emailing futuregenailabllc@gmail.com. We may suspend or terminate your access if you violate these Terms.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, Fitly AI and FutureGen AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or health outcomes, arising out of or related to your use of the Service. Our aggregate liability for direct damages will not exceed the amount you paid us in the 12 months preceding the claim.
14. Governing law
These Terms are governed by the laws of your country of residence to the extent required by applicable consumer protection law, otherwise by the laws applicable to FutureGen AI’s operating entity.
